Terms & Conditions
1. Company identification and scope
The website nautiwines.com (hereinafter the “Site”) is operated by NAUTIWINES - Consultoria e Comercialização de Vinhos, Lda., with registered office at Rua da Escola, n.º 184, Agarez, 5000-773 Vila Real, Portugal (“NautiWines”).
By accessing and using the Site, the user accepts these Terms and Conditions. If you do not agree with these terms, you must not use the Site or place any orders.
2. Purpose
These Terms and Conditions govern:

Access to and use of the Site.

The terms and conditions for the provision of wine consulting services.

The terms and conditions for the purchase and sale of wines and other products made available online by NautiWines.
Use of the Site is free of charge and does not require prior registration, without prejudice to the need to provide data in order to request services, quotations or place orders.
3. Minimum legal age for purchasing alcohol
The sale of alcoholic beverages to persons under 18 years of age is prohibited by law in Portugal.
By placing an order for wines through the Site, the customer declares that they are at least 18 years old and are legally allowed to purchase alcoholic beverages in their country of residence.
4. Consulting services
Whenever consulting and support services in connection with the selection, export or commercialization of wines are offered, the respective conditions (scope, fees, timelines, deliverables, etc.) will be defined in a commercial proposal or specific agreement entered into between NautiWines and the client.
The information made available on the Site regarding consulting services is for information purposes only and does not constitute a binding offer.
5. Products, prices and availability
The products presented on the Site are generally wines and other products marketed by NautiWines.
All prices are indicated in euros (€) and include VAT at the legal rate in force, unless stated otherwise.
Prices and product characteristics may be changed without prior notice, and the prices applicable are those displayed at the time the order is placed.
All products are subject to stock availability; in the event of stock shortage, the customer will be contacted with an alternative proposal, an adjustment to the order or a refund of the amount paid for the product(s) that are unavailable.
6. Ordering process
The customer selects the desired products, adds them to the cart (where available) and completes the checkout process, providing the requested data.
After submission, the customer may receive an automatic email confirming that the order or request has been received; this confirmation does not yet constitute final acceptance.
The order will only be deemed accepted after payment has been validated (where applicable) and stock availability has been confirmed, at which point it will be prepared for shipment.
NautiWines reserves the right to cancel or refuse orders, in particular in the following situations:

Obvious pricing or description errors.

Product unavailability.

Suspected fraud.
-
Breach of these Terms and Conditions.
7. Payment methods
The Site may offer the payment methods shown on the checkout page (for example, credit card, Multibanco reference, MB WAY or others, as may be available from time to time).
By selecting a payment method, the customer declares that they are the lawful holder of the payment instrument used.
All payments are subject to verification and authorization by the issuing entities; if payment is not authorized, the order will not be processed.
8. Delivery
Orders are shipped to the address provided by the customer at the time of purchase.
The delivery times indicated on the Site (for example, X–Y business days for mainland Portugal) are average timeframes and may vary due to reasons beyond NautiWines’ control (carrier issues, public holidays, weather conditions, among others).
Orders are normally shipped via partner carriers, using packaging suitable for transporting wine bottles.
Where possible, the customer will be informed in the event of significant delays.
9. Damaged or non‑conforming orders
Upon delivery, the customer must check the external condition of the packages. If any visible damage or signs of tampering are detected, the customer should:

Refuse the order or note the reservation on the carrier’s delivery slip.

Notify NautiWines as soon as possible by email to geral@nautiwines.com, indicating the order number and, where possible, attaching photographs of the damage.
In the event of damaged or non‑conforming products, the consumer rights provided under Portuguese law will apply, and replacement of the product, issuance of a credit note or refund may be offered, as appropriate.
10. Right of withdrawal (returns)
Where NautiWines sells to consumers, the consumer has the right to withdraw from the contract, without giving any reason, within 14 days from the date on which the products are received, in accordance with Portuguese Decree‑Law no. 24/2014, of 14 February.
To exercise this right, the customer must clearly communicate their decision (for example, by email to geral@nautiwines.com), indicating their details, contact information, order number and the products to be returned.
Products must be returned in perfect condition, in the original packaging, without signs of use and accompanied by the invoice. Unless the return is due to an error attributable to NautiWines, return shipping costs are borne by the customer.
After receipt and inspection of the products, the amount paid will be refunded within the legal timeframe, using the same payment method used for the original transaction, wherever possible.
11. Complaints
The customer may submit a complaint directly to NautiWines by email to geral@nautiwines.com or through the other contact details provided on the Site.
The customer may also use the Electronic Complaints Book available at www.livroreclamacoes.pt, in accordance with the applicable legislation.
12. Intellectual property
All content on the Site (texts, images, logos, design, etc.) is the property of NautiWines or is used with the authorization of the respective rights holders and is protected by intellectual property rights.
Use of the content for purposes other than personal and private use requires NautiWines’ prior written authorization.
13. Liability and use of the Site
NautiWines endeavours to ensure that the information presented on the Site is accurate and up to date, but does not guarantee the complete absence of errors or omissions.
NautiWines reserves the right to correct errors, update information or change content at any time, without prior notice, including prices, descriptions and product availability.
14. Personal data
The processing of personal data collected through use of the Site, contact requests, consulting requests or orders is governed by the Privacy Policy available on nautiwines.com.
By using the Site and providing personal data, the user declares that they have read and accepted that Policy.
15. Changes to the Terms and Conditions
NautiWines may amend these Terms and Conditions at any time.
The new versions will be published on the Site and will apply to use of the Site and orders placed after the date of publication.
16. Alternative Dispute Resolution for Consumer Disputes
In the event of a consumer dispute, the consumer may resort to an alternative dispute resolution (ADR) entity.
In particular, and without prejudice to any other entity that may be competent depending on the place where the contract is concluded and the national list of ADR entities, consumer disputes may be resolved through consumer dispute arbitration centres of general competence, namely the CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (National Centre for Information and Arbitration of Consumer Disputes), for the national territory not covered by another arbitration centre included in the national ADR network.

17. Applicable law and jurisdiction
These Terms and Conditions are governed by Portuguese law.
In the absence of an amicable resolution or use of legally available mechanisms, any dispute arising out of or in connection with the interpretation or performance of these Terms and Conditions will be submitted to the competent Portuguese courts.
